Ct-24 ar 16.12.2020 WPA 9606 of 2020 Anowarul Islam Vs.

The State of West Bengal & Ors.

Mr. Habibur Rahaman ... For the Petitioner Ms. Chaitali Bhattacharya Mr. Subhendu Roy Chowdhury ... For the State Mr. M.V. Sarwar Jahan ... For the Respondent no. 2 The father of the petitioner was engaged as 'Sahayika' in Sishu Shiksha Kendra. He died-inharness in 17th January, 2020. The petitioner seeks compassionate appointment.

The learned advocate representing the respondent no. 2 submits, upon instruction, that there is no scheme for providing appointment on compassionate ground in the Sishu Shiksha Kendra.

In the absence of a scheme there is no scope for consideration of the case of the petitioner for being appointed on compassionate ground.

It is settled law that compassionate appointment is not a regular source of employment and can be given only if the scheme specifies for the same.

As there is no scheme for appointment on compassionate ground the prayer of the petitioner cannot be considered.

Accordingly, the writ petition is devoid of merit and is hereby dismissed.

Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
