Mofijul Sk. v. State Of West Bengal
01.12.2020 SL No.54 AP CRM 9495 of 2020 (Through Video Conference) In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with Kandi P.S. Case No.320 of 2019 dated 06.08.2019 under Sections 302/34 of the Indian Penal Code and Sections 25/27 of the Arms Act.
And In the matter of: Mofijul Sk.
....Petitioner.
Ms. Minoti Gomes ...for the Petitioner.
Mr. Saibal Bapuli, Ld. A.P.P., Mr. S. Ganguly ...for the State.
Having considered the materials on record disclosing prima facie involvement of the petitioner in the murder and as his prayer for bail was rejected earlier on a number of occasions, we are not inclined to grant bail to the petitioner.
The application for bail is, thus, rejected.
However, we direct the trial court to expedite the trial and conclude the same at an early date without granting unnecessary adjournment to either of the parties.
The parties shall act in terms of the copy of the order downloaded from the official website of this court.
