Mr. Kishore Mukherjee ...... for the petitioner (in both matters) Mr. Dipanjan Datta ...... for the Bank of Baroda (in WPA 9636 of 2020) In Re : WPA 9636 of 2020 This writ petition has been filed seeking issuance of a writ of mandamus commanding the Bank of Baroda to remove the debit holds imposed on certain bank accounts, fixed deposit certificates, and a locker. It is stated that, pursuant to a complaint, Hare Street P.S. Case No. 198 of 2020 dated 04.09.2020 under Section 404 of the Indian Penal Code was registered, in consequence whereof the said bank accounts, fixed deposit certificates, and locker were directed to be frozen. The petitioner, by filing a supplementary affidavit, has brought to the notice of this Court that a Co-ordinate Bench, by order dated 18th December, 2024 passed in CRR 4817 of 2022,

quashed Hare Street P.S. Case No. 198 of 2020 dated 04.09.2020 under Section 404 of the Indian Penal Code. Pursuant thereto, the learned Chief Metropolitan Magistrate, Kolkata, by order dated 17th March, 2022, directed the Bank to remove the debit holds from the concerned accounts, fixed deposit certificates, and locker.

In the course of hearing, Mr. Dutta, learned Advocate appearing for the Bank of Baroda, submits that upon verification of the certified copies of the order passed in CRR 4817 of 2022 as well as the order passed by the learned Chief Metropolitan Magistrate, Calcutta, necessary steps shall be taken in due course.

Having heard the learned advocates for the respective parties and upon perusal of the materials on record, this writ petition is disposed of with a direction upon the Bank concerned to remove the debit holds on the accounts, fixed deposit certificates, and locker referred to in the order dated 17th March, 2022 passed in G.R. Case No. 997 of 2020, in terms of the said order, upon completion of all necessary formalities, within two weeks from the date of receipt of a copy of this order. With the aforesaid observations and directions, this writ petition stands disposed of. In view of such disposal, WPA 8607 of 2020, wherein a similar issue is involved, is also disposed of. There shall be no order as to costs.
