16 & 17 01.07.2022 KC C.P.A.N. 734 of 2021 in WPA 9655 of 2020 Sudam Sarkar Vs.

Sri Malay Sikdar Mr. Tapas Kumar Ghose Mr. Tanmoy Chowdhury.

... for the petitioner.

Mr. Rammohan Chattopadhyay ... for the alleged contemnor.

Petitioner complains of violation of the order dated July 8, 2021 passed in the writ petition. By such order, the respondent no. 5 of the writ petition was directed to consider a representation with regard to a bill of the petitioner.

The petitioner complains that, such order remains uncomplied with.

The order dated July 8, 2021 records that the bill is of 2019.

There is a point of limitation involved.

At this stage, therefore, requiring any authority to decide something, which is not permissible in law, does not

arise. Therefore, it cannot be said that there is an willful violation in the order passed in the writ petition. In such circumstances, I am not minded to exercise jurisdiction under Article 215 of the Constitution of India read with provisions of the Contempt of Courts Act, 1971.

C.P.A.N. 734 of 2021 stands disposed of.
