It is submitted on behalf of the petitioner that he is in custody for more than three years and he renews his prayer for bail. Learned lawyer for the State opposes the prayer for bail and submits that the petitioner was dealing with narcotic substance above commercial quantity.

Having considered the materials on record and bearing in mind the prima facie involvement of the petitioner in dealing with narcotic substance above commercial quantity and in the light of the statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.

However, in view of the period of detention already suffered by the petitioner, we direct the trial court to take necessary steps to conclude the trial at an early date without granting unnecessary adjournment to either of the parties.

The parties shall act in terms of the copy of the order downloaded from the official website of this court.
