07.08.2023 BP Court No. 17 Sl.32 W.P.A. 9672 of 2020 Tarun Kumar Das & Ors.
Vs.
The State of West Bengal & Ors.
Mr. Ayan Kumar Boral Mr. Anisur Rahman ... for the petitioners Mr. Saikat Banerjee Mr. Ratul Biswas Mr. Kaushik Chowdhury ..for the Board Mr. Ranjan Saha ..for the State The petitioners obtained qualification of D.El.Ed. 2017-2019 examination held in March, 2019. The petitioners seek benefit as to their scale of pay etc. from the date of publication of the said training qualification result.
I direct the concerned District Inspector of Schools to hold a meeting within a period of six weeks from the date of communication of this order with the petitioners and the school authority. After such hearing, the D.I. will pass a reasoned order by two weeks thereafter. The reasoned order is to be communicated to the petitioners by two weeks from the date of passing the said order. The petitioners are granted liberty to be represented by their learned advocate.
However, it is made clear that if the District Inspector of Schools thinks the petitioners are entitled to get the scale of pay etc. from the date of attaining the qualification he should not hesitate to pass such an order in favour of the petitioners. With the above observation and direction, this writ application is disposed of.
