Public Prosecutor Mr. Nirupam Dhali .. Advocate ... ... for the State It is submitted on behalf of the petitioner that he is the cousin brother-in-law of the deceased housewife. It is further submitted that he did not play any role in the torture of the housewife. Learned Additional Public Prosecutor opposes the prayer for anticipatory bail.
We have considered the materials on record including the statements of neighbours recorded under Section 164 of the Code of Criminal Procedure disclosing presence of the petitioner along with other accused persons who abused the housewife on the day she suffered unnatural death due to burns. In view of the prima facie role of the petitioner as aforesaid, we are not inclined in granting anticipatory bail to him.
Accordingly, the prayer for anticipatory bail of the petitioner stands rejected.
