Affidavit of service showing notice on the alleged second wife, Ms. Ana Sarkar has been filed. The said Ms. Ana Sarkar is not represented in Court today. Mr. Sudipto Panda, learned advocate for the State submits that the B. D. O. has caused an enquiry and found that the petitioner is the only wife of the deceased, Kausik Sarkar, Nirman Sahayak, Jhalda -II Block.

The petitioner has applied for compassionate employment in place and stead of her deceased husband.

Learned advocate for the State submits that three-man committee is required to submit a report to the concerned authority for taking suitable decision on the propriety of claim of the petitioner.

The respondent no. 4 is directed to ensure threeman committee will submit a report to the District Magistrate, Purulia/respondent no. 2 within three months from the date of communication of a copy of this order.

The District Magistrate, Purulia shall pass suitable orders within a month thereof.

Needless to mention that if the petitioner found eligible for appointment, the petitioner shall be given a post.

The District Magistrate has issued a legal heir certificate indicating that the petitioner and her mother and daughter are the only legal heirs of Kausik Sarkar on 09.12.2020.

With the aforesaid observations, the instant writ petition is disposed of.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all formalities.
