This is an application for expeditious disposal of Money Execution Case No.12 of 2017 arising out of L.A. Misc. Case No.24 of 2013 pending before the learned Additional District Judge, 1st Court (L.A. Tribunal) at Howrah.

It is submitted on behalf of the petitioner that the L.A. case was registered in 2017. Thereafter the matter appeared on several dates but the opposite parties have been taking adjournments in the matter. It also appears that by an order dated September 2, 2019, the learned Judge, L.A. Tribunal, Howrah had directed the Special L.A. Collector (HIT), Howrah to submit the report on the next date positively with regard to the cause of delay in payment of compensation money to the petitioner. It is further submitted that the petitioner is aged about 86 years and he is suffering due to the unnecessary delay on the part of the opposite parties.

Under such circumstances, justice would be subserved if the learned Additional District Judge, 1st Court (L.A. Tribunal,

Howrah) is directed to dispose of the Money Execution Case No.12 of 2017 as expeditiously as possible without further unnecessary delay and not later than 6 months from the date of communication of this order on its own merits. This Court has not gone into the claims and counterclaims of the parties.

This revisional application is, thus, disposed of. There will be, however, no order as to costs. The learned Advocate-on-record for the petitioner is directed to serve a copy of this revisional application along with a server copy of this order to the opposite parties within a week.
