The learned advocate for the petitioner is present. The learned advocate for the petitioner submits that the petitioner is aggrieved by the order dated 04.02.2020 wherein the learned Additional Chief Judicial Magistrate, Ghatal, Paschim Medinipur was pleased to issue warrant of arrest as the surety did not take any step. The learned advocate further submits that the petitioner is presently 72 years old and there was no laches on his part or any intention to evade due process of law.
The petitioner is directed to serve a copy of the application upon the learned Public Prosecutor who appears on behalf of the State.
Without going into the merits of the contentions placed by the learned advocate for the petitioner, this Court feels that an opportunity should be granted. Accordingly, it is directed that if the petitioner surrenders by 24.12.2020, in the instant case, the petitioner shall be allowed to continue
on the same bail and bond which was earlier furnished before the learned court below.
However, in view of the conduct of the petitioner not being very satisfactory, the petitioner is directed to be present on each and every date so fixed by the learned Additional Chief Judicial Magistrate, Ghatal, Paschim Medinipur and also to meet with the Officer-in-Charge of Daspur Police Station once a week and receive an acknowledgement to the said effect from the office of the learned Additional Chief Judicial Magistrate, Ghatal, Paschim Medinipur until further orders of this Court.
With the aforesaid observations, CRR 1656 of 2020 is disposed of.
Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with the necessary formalities.
