Md. Ashraful Huq for the petitioner Mr. Rajdeep Biswas, Ms. Suparna Biswas for the respondent nos. 1-4 The petitioner aspired to join the CAPF. He appeared in the recruitment examination where he was declared medically unfit by the Medical Officer. The petitioner got himself checked up from a Doctor of the State Government Hospital and applied for review medical examination.

The Review Medical Board reiterated the order of the Medical Officer and declared him unfit.

Being aggrieved the petitioner filed a representation before the head of the recruiting authority praying for remedical examination. As his application was not considered the petitioner approached this court by filing the instant writ petition.

During the pendency of the writ petition, it appears that the prayer of the petitioner for conducting fresh medical examination has been forwarded by the Under

Secretary, Staff Selection Commission to the DIG (Recruitment) by a communicating letter dated 14th December, 2020.

As it appears that the prayer of the petitioner for re-medical examination is pending active consideration at the end of the respondent no order is required to be passed in this matter at this stage. The respondent shall act in accordance with the communication that was made by the Under Secretary, Staff Selection Commission to the DIG (Recruitment) on 14th December 2020.

WPA 9743 of 2020 is disposed of.

The communication dated 14th December 2020 made by the Under Secretary, Staff Selection Commission to the DIG (Recruitment) is retained with the records.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
