In response to a recruitment notice published on 29th March, 2018 the petitioner applied for appointment in the post of Gram Panchayat Secretary under the OBC-A exempted category.

As per the notification there is only one vacancy in respect of OBC-A exempted category for the post of Gram Panchayat Secretary.

The petitioner submits that he was successful in the written examination as well as viva voce. He further submits that the final merit list of the Gram Panchayat Secretary was published on 13th November, 2020. In the final merit list, the name of the petitioner is appearing under the heading "General category wait listed panel".

The petitioner submits that since he applied in the OBC-A exempted category, his name ought not to have appeared in the panel for General category.

The petitioner also submits that since there is urgency in the matter, he approached this Court directly without making any representation to the respondent authority. He however, submits that the petitioner visited the office of the respondent authority personally, but in view of the pandemic situation the authority

did not permit him to enter into the office.

Be that as it may, as it appears from the record that the petitioner is a member of the OBC-A exempted category and he applied in the said category it is not clear why the name of the petitioner has been enlisted in the final merit list for the General candidates.

Accordingly, the instant writ petition is disposed of by granting liberty to the petitioner to approach the respondent nos. 5 & 6, highlighting his grievances by filing a composite representation along with all supporting documents within 23rd December, 2020.

In the event, such representation is made the said respondents shall consider the representation of the petitioner strictly in accordance with law and the recruitment notice within a period of three weeks thereafter.

The said respondents shall pass a reasoned order and communicate the same to the petitioner immediately thereafter.

WPA 9776 of 2020 stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
