IN THE HIGH COURT AT CALCUTTA

Criminal Revisional Jurisdiction CRR No.1675 of 2020 Abhisek Goswami & Anr.

-vsThe State of West Bengal & Anr.

with CRAN No.1 of 2021 None ...for the petitioners Mr. Saibal Bapuli Mr. Soumik Ganguli ... for the State Mr. Shankar Mukherjee ...for OP no.2 This revisional application has been preferred in connection with Belgharia P.S. Case No.622 of 2019 dated September 11, 2019 under sections 498A/406/34/313 IPC and the police authorities on conclusion of investigation submitted charge-sheet. The present petitioners happen to be the husband and fatherin-law of the second opposite party. The revisional application was admitted by giving an impression to the court that the disputes and differences between the petitioner and the second opposite party are to be resolved.

Learned advocate appearing for the second opposite party opposes such contentions and submits that there was talk of amicable settlement, but that the same is not materialised. Having regard to the issues on which the revisional application was preferred, I am of the view that the points canvassed are question of facts which cannot be adjudicated by this court at the pre-trial stage.

In view of the above, no interference is called for in this revisional application.

As such, CRR No.1675 of 2020 is dismissed.

Pending applications, if any, are consequently disposed of. Interim order, if any, stands vacated.

All parties are to act on the server copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
