...... petitioners Mr. B Jha Mr. Ravi R Kumar ...... for the petitioners Mr. S G Mukherjee ...... for the State It is submitted on behalf of the petitioners that there was commercial transaction between the parties and consignment sought to be supplied has deteriorated due to heavy rain. Learned lawyer for the State opposes the prayer for bail. Having considered the materials on record and bearing in mind the nature of allegation in the light of the submission made on behalf of the petitioners, we are of the opinion custodial interrogation for verification of allegation is not necessary and they may be granted anticipatory bail.

Accordingly, we direct that in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs. 10,000/- each with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that while on bail petitioners shall meet the investigating officer once in a week until further orders.
