02. 12 . 2020 CRM 9653 of 2020 (Via Video Conference) In re: An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 in connection with Bishnupur Police Station Case No. 185 of 2020 dated 23.03.2020 under Sections 448/325/326/307/354/379/34 of the Indian Penal Code.
BP/BR Sl. 22 In the matter of : Arif Sk & Ors........petitioners Mr. Indrajeet Roy Chowdhury Mr. Joydipta Mondal ..for the petitioners.
Mr. Iqbal Kabir ..for the State.
It is submitted by the learned advocate for the petitioners that the petitioners are innocent persons. They have been falsely implicated in the present case. Therefore, the petitioners should be enlarged on bail. Learned advocate for the State opposes the prayer for bail and submits that the petitioners are in a habit of grabbing land in that area. Earlier the criminal case was initiated against the petitioners. Therefore, court should not entertain this application for anticipatory bail.
Considering the submissions as advanced by
the learned advocates for the parties and after perusing the case diary, in our considered view, the application for anticipatory bail should not be allowed. Accordingly, the application for anticipatory bail is rejected.
The application for anticipatory bail being C.R.M. 9653 of 2020 is disposed of.
