We have considered the materials on record and bearing in mind the prima facie involvement of the petitioner in the alleged possession of 5.3 litres of phensedyl syrup containing codeine mixture above commercial quantity and in the light of the statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner. The application for bail is, thus, rejected.
