Mr. Panda, learned advocate appearing for the petitioner submits that the petitioner submitted an application for general transfer on special ground in terms of the West Bengal School Service Commission (General Transfer, Transfer on Special Ground and Reallocation) Rules, 2015.

Upon considering the same, the school authorities granted "no objection" and forwarded the petitioner's application to the respondent no.6, who in turn, forwarded the same to the respondent no.3, as required under a notification dated 16th October, 2020 issued by the Principal Secretary, Government of West Bengal, School Education Department.

The fact that the petitioner's application along with all relevant documents have been forwarded to the respondent no.3, has not been disputed by Mr. Basu

Mallick, learned advocate appearing for the State respondents.

In view thereof, this Court directs the respondent no.3 to consider the petitioner's application for general transfer on special ground, as forwarded by the respondent no.6 and to take all follow up steps, in accordance with law, within a period of four weeks from the date of communication of this order along with a copy of the writ petition.

In the event the petitioner's application for general transfer on special ground cannot be allowed, a reasoned decision to that effect should be communicated by the respondent no.3 to the petitioner within the period as specified above.

With the above observation and direction, the writ petition is disposed of.

There shall be no order as to costs.

Urgent Photostat certified copy of this order, if applied for, be supplied to the parties on completion of all necessary formalities.
