The petitioner undertakes to affirm and stamp the petition as per the Rules within one week of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.
The petitioner claims that though no contraband was recovered from the possession of the petitioner, the State has pursued the petitioner on the basis of the statement of a person arrested earlier.
The State produces the records. It appears that from one Rubel Mondal and Mansur 100 bottles of Phensedyl were recovered and such persons have allegedly named this petitioner as a part of the gang. However, there is no independent material which has been obtained against this petitioner to indicate his complicity. In the light of the above, the petitioner is entitled to bail. The petitioner will be enlarged on bail upon furnishing security of Rs.10,000/- (Rupees Ten Thousand only) with two
sureties of equal amount each, one of whom must be local, to the satisfaction of the appropriate court in Dakshin Dinajpur. CRM 9801 of 2020 is disposed of.
