Mr. S. Shah, Mr. Soumen Barman ...for the petitioner The petitioner seeks a direction on the private respondents to remove a fence and drain from public land and a direction upon the police to permit such land to be used as a public road.

There is no finding from any authority that the land in question is a public road. The question of police taking any step in this regard, therefore, cannot arise.

The Raidighi Police Station shall, however, ensure that there is no breach of peace in the area. With the aforesaid observations, the instant writ petition shall stand disposed.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
