The petitioners are aggrieved by the issuance of warrant of arrest by the learned Judicial Magistrate, 4th Court, Durgapur. I find that the complaint case is under Section 138 of the Negotiable Instruments Act and the original complaint was filed in the year 2015. The petitioners are directed to deposit a sum of Rs.1,50,000/- as an interim measure under the statutory provisions of Negotiable Instruments Act. The petitioners, after the deposit being tendered through learned advocate, would appear/surrender before the learned Magistrate by 22nd February, 2022. In case, the petitioners surrender, the learned Magistrate would release them on bail on such terms and conditions as the learned Magistrate would deem fit and proper.
The warrant of arrest so issued be stayed till 25th
February, 2022.
With the aforesaid observations, CRR 1694 of 2020 and all connected applications are disposed of.
