Datta, Mr. Tapas Kumar Dey ...for the State Mr. Dhananjay Banerjee, Ms. Oindrila Ghosh ....for the private respondent Counsel for the private respondent submits that there is a civil suit being T.S. No. 328 of 2021 between the petitioner and the private respondent, now pending before the learned 7th Civil Judge (Senior Division), Alipore for partition. The result of the suit shall decide the share of the respective family members.

The report of the Maheshtala Police Station indicates that they have initiated a proceeding under Section 107 of the Cr. P.C.

Counsel for the private respondent appropriately submits that his client has no objection to police protection being granted to the petitioner since, in fact, the petitioner is not in any way being disturbed by his client.

In those circumstances, the Officer-inCharge, Maheshtala Police Station shall keep a regular vigil on the said premises and also post a constable outside the disputed premises for a period of 4 days.

The petitioner shall communicate this order to the counsel for the State as also the Maheshtala Police Station.

With the aforesaid directions, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
