Learned advocate appearing for the insurance company makes over a cheque bearing No. 948328 dated September 15, 2021 drawn on HSBC Limited for the sum of Rs.5,70,578/- to the learned advocate appearing for the petitioner in Court along with Tax Deducted at Source (TDS) Certificate relating thereto.

Learned advocate appearing for the Insurance Company submits that, the insurance company deposited a cheque for the same amount before the Tribunal. Since the insurance company made over the cheque in Court to the petitioner, the insurance company is at liberty to withdraw the cheque from the Tribunal so deposited.

In such circumstances, CPAN 627 of 2020 is disposed of.
