Case No. 173 of 2019 dated 07.08.2019 under section 135(1)(a) of the Electricity Act. And In the matter of : Sekh Alauddin @ Mohammad Alauddin Sekh & Anr.

Mr. Sujoy Sarkar ... ... for the petitioners Mr. Anowar Hossain Ms. Ratna Ghosh ... ... for the State Mr. Aniket Mitra ... ... for the WBSEDCL It is submitted on behalf of the petitioners that they have deposited a sum of Rs. 23,640/- and Rs. 25,310/- respectively against the bill for unmetered consumption of electricity to the tune of Rs. 47,278/- and Rs. 50,615/- respectively. In view of the aforesaid fact and bearing in mind the nature of allegations, we are inclined to grant anticipatory bail to the petitioners.

Accordingly, we direct that in the event of arrest the petitioners shall be released on bail upon furnishing a bond of Rs. 2,000/- each with two sureties of like amount each to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.

This application for anticipatory bail is, thus, allowed. The parties shall act in terms of the copy of the order downloaded from the official website of this court. (Suvra Ghosh, J.) (Joymalya Bagchi, J.)
