Mr. Shreyan Das Mr. Suryaneel Das Mr. Arijit Patnaik ..for the Petitioner Mr. Sirsanya Bandopadhyay Mr. Subhendu Dasgupta ....for the State Learned Counsel appearing for the petitioner submits that the petitioner, a domicile in the State of West Bengal, is a State quota candidate, but as his father was transferred to the State of Maharastra, he stays with his father at Maharastra. The Counsel further submits that the petitioner is a meritorious student who appeared for National Eligibility cum Entrance Test, 2020 conducted by National Testing Agency and had secured an All India Rank of 93907, but as the petitioner belongs to Scheduled Caste category his rank is 4095 in that category. For reasons beyond his control, the petitioner could not appear before the first counselling session at Bankura Sammilani Medical College, Bankura and prays for a chance to appear before the authorities, as the second counselling is going on and will end tomorrow that is on 12th December, 2020.

Mr. Bandopadhyay, learned Counsel appearing for the State in all his fairness submits that the student/petitioner should get a chance to appear before the second counselling but on provisional basis and the State and the National Informative Center will provide every facility to the student so that the student can take necessary steps and submit all necessary documents before the authorities.

Heard both the parties.

As the dispute regarding appearing for second counselling that will conclude tomorrow has been resolved, it is directed that the petitioner will appear before the authorities with all his documents and get his name registered for admission on provisional basis, but the final admission of the petitioner will depend on the result of this writ petition.

Learned Counsel appearing for the State is requested to file their affidavit-in-opposition within 4 (four) weeks from date, reply thereto, if any, within 2 (two) weeks thereafter.

Let the matter again appear in the monthly list of February, 2021.
