21.12.2020 ss Allowed C.R.M. 9863 of 2020 (Through Video Conference) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Sadaipur P.S. Case No. 75 of 2019 dated 12.07.2019 under sections 147/148/149/307/506/120B/419/420/467/468/471 of the Indian Penal Code and sections 3/4 of the Explosive Substance Act.

Mr. Somnath Banerjee Mr. Pronojit Ray ... ... for the petitioners Mr. Rana Mukherjee, APP Ms. Sujata Das ... ... for the State We have considered the materials on record. There was dispute amongst the villagers over misappropriation of funds released by the State. No one was injured in the incident. Under such circumstances, we are inclined to grant anticipatory bail to the petitioners.

Accordingly, we direct that in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand Only) each, with two sureties of like amount each, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.

This application for anticipatory bail is, thus, allowed.
