This is an application praying for expeditious disposal of the injunction application filed by the plaintiffs/petitioners under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure in connection with Title Suit No.305 of 2013 pending before the learned Civil Judge (Junior Division), 1st Court at Alipore.

From the perusal of the order sheet, it appears that the defendants had delayed in filing the written statement and ultimately by an order dated November 26, 2019, the written statement was accepted. It appears that the defendants have also filed several applications in the meantime. However, the temporary injunction application has not yet been disposed of. Under such circumstances, as the normalcy has been restored in the court, the learned Court below is directed to dispose of the application for temporary injunction as expeditiously as possible without unnecessary delay and preferably within a period of two months from the next date

fixed. The learned Court below is directed to ensure that the application is ready as regards service upon all the defendants and allow the defendants to file the written objection if not already filed.

This revisional application is, thus, disposed of. There will be, however, no order as to costs. The learned Advocate-on-record for the petitioners is directed to serve a copy of this revisional application along with a server copy of this order to the opposite parties within seven days.
