The petitioner complains that the private respondent has forcefully driven her out from a house which was constructed under a scheme, by the Government, upon funds being sanctioned by the Baruipur Municipality. The private respondent is the owner of the said plot of land where the construction has been made.

The private respondent denies that he has driven out the petitioner forcefully from the said premises.

It appears from the submissions made on behalf of the parties that the issue involved herein is civil in nature and cannot be decided by the writ Court.

The petitioner has prayed for restoration of possession of the dwelling house. The petitioner will be at liberty to approach the appropriate forum, strictly in accordance with law, if so advised. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon completion of usual legal formalities.
