Mr. Somnath Roy Chowdhury .....For the petitioner Mr. Amitava Mitra .....For the State The petitioner claims to be owner of a plot of land together with the building standing thereon situate at Dag No. 1664, Khatian (R.S.) - 1000, Khatin (L.R.) - 682, Mouza - Deulia, J.L. No. 68, Police Station Deganga, North 24-Parganas, West Bengal (hereinafter referred to as "the said plot of land"). She has alleged that without taking any recourse for acquiring the said plot of land the State respondents are intending to construct a highway over the said plot of land. Thus, the petitioner has prayed various reliefs to protect her plot of land.

Mr. Amitava Mitra, learned counsel appears for the State respondents and submits to have received an instruction from the respondent no. 3, the Executive Officer Highway Division No. 1, Public Works (Roads) Directorate that there is no plan to construct any road over the said plot of land owned by the petitioner. In view of the above submission made on behalf of the respondent no. 3, the respondents are not called on to file any affidavit and I do not find any reason to keep the writ petition pending before this Court.

The writ petition being WPA 9979 of 2020 is disposed of by directing the State respondents and each of them not

to interfere possession of the petitioner in respect of the said plot of land or the building standing thereon without acquiring the land.

There shall, however, be no order as to costs. The parties shall act in terms of the copy of the order downloaded from the official website of this Court. ( Ashis Kumar Chakraborty, J. )
