Sutapa Das Ms. Saheli Mukherjee ... ... for the petitioner Mr. Sudip Ghosh Mr. Bitasok Banerjee ... ... for the State It is submitted on behalf of the petitioner that there is a dispute between the existing Managing Committee and the erstwhile Committee relating to administration of the Madrasah. Allegation of use of forged document is out and out false.
Learned lawyer for the State submits that the Madrasah Board claimed that the petitioner had not been recommended by the Board.
Investigation does not indicate the nature of forged document used in support of the plea that the petitioner had been recommended by the Board for appointment. We are informed that petitioner has since resigned from her post. In view of the aforesaid facts, we are of the opinion though custodial interrogation may not be necessary,
petitioner requires to co-operate with investigation in accordance with law.
Accordingly, we direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand Only), with two sureties of like amount each, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973. This application for anticipatory bail is, thus, allowed. The parties shall act in terms of the copy of the order downloaded from the official website of this court. (Suvra Ghosh, J.)
