Siddiqui Mr. Aniruddha Mohata ..... for the State The petitioners challenge the order dated 4th September, 2020 issued by the Block Development Officer, Arsha Development Block, wherein it has been mentioned that the meeting which was convened by ten members on 24th August, 2020 does not conform to the necessary provision of the West Bengal Panchayat Act, 1973 as amended.

The Block Development Officer did not mention the specific provision of the West Bengal Panchayat Act, 1973 which has not been followed by the members at the time of adopting the resolution. In the absence of specific reasons being mentioned in the aforesaid order the same cannot be held to be valid in the eye of law.

In view of the above, the order dated 4th September, 2020 is set aside.

The Block Development Officer shall be at liberty to pass a fresh order, in accordance with law, and communicate the same to the petitioners immediately thereafter.

The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon completion of usual legal formalities.
