After hearing the Counsels for the respective parties for a substantial period of time and after this Court found suppression of material facts in the writ application, Counsel for the petitioner seeks liberty to withdraw the said writ application.

Hence, W.P.A. No. 10041 of 2020 shall stand dismissed as withdrawn, upon payment of costs assessed at Rs.5,100/- to be paid by the petitioner in equal share to the private respondent no.11 and the State.

In the event of non-payment of costs, as indicated hereinabove, within a period of one month from date, the State shall be entitled to take steps under Bengal Public Demand Recovery Act, 1913 for the said purpose.

Photostat copies of the orders dated 2nd July, 2020 in W.P. No. 5697 (W) of 2020 and 21st November,

2019 in W.P. No. 20774 (W) of 2019 may be kept with the record.
