Mukherjee......for Contai Municipality Mr. Soumen Dutta Mr. Subhadeep Chatterjee......for respondent no. 5 Mr. Bhattacharya, learned advocate appears on behalf of petitioner and submits, in his client's earlier writ petition [W.P. 1759(W) of 2019] there was order dated 20th February, 2019, by which coordinate Bench (Tapabrata Chakraborty, J.) directed the Municipality to consider representation dated 11th July, 2017, of his client, regarding there being two plans in respect of same premises. Nothing has been done by the Municipality. For this submission, he relies on hearing notice dated 26th March, 2019. Mr. Dutta, learned advocate appears on behalf of private respondent and refers to letter dated 6th September, 2019 written by petitioner saying no step for settlement in the matter had been taken by the concerned office of the Municipality. Mr. Dutta

submits, petitioner had, after the hearing raised talk of settlement. As such, the matter remained pending. Mr. Bilwadal Bhattacharya, learned advocate appears on behalf of the Municipality and submits the same. He adds that if his client is to deal with the representation, then eight weeks time be given. Mr. Bhattacharya submits, fresh hearing be given to his client.

The Municipality will consider said representation upon giving fresh hearing to petitioner and private respondent. Decision on the representation should be made known to them within six weeks from date of communication of the order. Writ petition is disposed of.
