This application has been filed by the plaintiff in Title Suit No. 414 of 1993 pending before the learned Civil Judge (Junior Division), 1st Court at Barasat.

Records reveal that the service of summons is not complete and also that the plaintiff has also failed to take steps.

Under such circumstances, this revisional application cannot be entertained by this court at this stage as the delay has occurred on the part of the plaintiff. This application is rejected. However, if the suit drags on at a later stage for no fault of the plaintiff, the plaintiff/petitioner will be at liberty to pray for expeditious disposal at the appropriate stage.

Urgent photostat certified copy of this order, if applied for, be given to the parties as expeditiously as possible subject to compliance of all usual formalities.
