Hence, he does not stand on the same footing with the co-accused namely, Samim Aktar Mallick @ Samim Akter Mollick who has been enlarged on bail. In view of the primary role played by the petitioner in the assault of the deceased, we are of the opinion that this is not a fit case to grant bail to the petitioner at this stage.

The application for bail is thus rejected.
