Mr. Rajesh Singh, learned advocate appearing on behalf of the Bajaj Allianz General Insurance Co. Ltd. submits on instruction that the Insurance Company do not want to proceed further with this appeal. Mr. Singh handed over the written instruction. Let the instruction be kept in the record.

Mr. Singh further submits that interim order of stay was passed by this Court but the claimant has already executed the order before the learned Tribunal. Accordingly, further proceeding of the appeal is not necessary.

Considering the submission and also taking note of the written instruction of the Insurance Company, the instant appeal is hereby disposed of as not pressed. The interim order of stay passed by this Court on the earlier occasion is hereby also vacated.

The office of the learned Registrar General, High Court, Calcutta is directed to refund the already deposited

Statutory amount of Rs.25,000/- amount along with accrued interest on usual prayer.

Accordingly, FMA 1035 of 2022 is disposed of. LCR be send down at once.
