The petitioner claims that the private respondent are creating domestic violence for which he has approached the Additional Chief Judicial Magistrate, Alipore under Section 12 of the Protection of Woman from Domestic Violence Act, 2005.
The petitioner says that she has lodged several complaints before the Officer-inCharge, Jadavpur Police Station as the private respondents have assaulted the petitioner and threatened her with dire consequences. But
the said Officer has not taken steps on the basis of the complaints lodged by the petitioner.
Mr. Banerjee, learned Senior Advocate appearing for the State submits that on the basis of the complaints of the petitioner, Jadavpur Police Station Case Nos. 313 of 2018 and 20 of 2019 dated 7.9.2018 and 7th January, 2019 respectively have been started. Investigation in connection with both the cases have concluded and charge sheet has been submitted. Mr. Banerjee submits that there are civil disputes between the petitioner and the private respondent herein.
The learned Advocate for the private respondent submits that the petitioner has made false allegations against the private respondent herein.
I have heard the learned Advocates for the parties and I have considered the materials on record. Since the police have already taken steps on the basis of the complaints lodged by
the petitioner and charge sheet have been filed in connection thereto, the allegations of police inaction made by the petitioner in the instant writ petition is without any basis.
The writ petition being WPA 10102 of 2020 is thus, devoid of any merit and the same is dismissed without however any order as to costs.
Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis upon compliance of all formalities.
