Advocate ... ... for the State It is submitted on behalf of the petitioners that co-accused persons have been granted pre-arrest bail. It is further submitted that there is no material to show that the petitioners had abetted the suicide of the victim.

Learned advocate appearing for the State opposes the prayer for anticipatory bail.

We have considered the materials on record in the light of the aforesaid submissions made on behalf of the petitioners. Co-accused persons have been granted pre-arrest bail. Petitioners stand on the same footing with the co-accused persons. Hence, we are inclined to extend the same privilege to the petitioners also. Accordingly, we direct that in the event of arrest, the accused/petitioners, namely (1) Satyabala Roy @ Sati Roy & (2) Nimai Singh, be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only) each, with two sureties of like amount each, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
