Learned advocate appearing for the State opposes the prayer for anticipatory bail.
We have considered the materials on record in the light of the aforesaid submission made on behalf of the petitioners. Co-accused has been granted pre-arrest bail. Petitioners stand on the same footing with the co-accused who has been granted pre-arrest bail. Hence, we are inclined to extend the same privilege to the petitioners also. Accordingly, we direct that in the event of arrest, the accused/petitioners, namely (1) Pradip Sarkar & (2) Provat Sarkar @ Pravas Sarkar, be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only) each, with two sureties of like amount each, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
