Petitioner is in custody for 1 year and 4 months. He submits that co-accused Deepa Majumder has been enlarged on bail. Learned lawyer for the State opposes the prayer for bail and submits that petitioner was arrested immediately after the incident and stolen articles were recovered from him.

Having considered the materials on record. We find that the stolen articles were recovered from the petitioner soon after the incident and as he stands on a different footing from the co-accused Deepa Majumder, who has been enlarged on bail, we are not inclined to grant bail to the petitioner.
