The innocuous prayer made in the writ petition is that, the second appeal filed by the petitioner under Section 19 of the Right to Information Act, 2005, due to alleged inaction on the part of the first authority to furnish information as applied for by the petitioner, is pending inordinately, for which the petitioner has been suffering for long.

It appears from the affidavit-of-service, filed in Court today, that although a copy of the writ petition has been sent to the respondent no. 1, no service has been effected as yet.

Learned counsel appearing for the respondent no. 1 submits that he can argue on the matter properly upon getting instruction.

However, in view of the innocuous nature of the prayer made in the writ petition, there is no necessity of keeping the matter pending.

Learned counsel appearing for the petitioner is directed to serve a copy of the writ petition on learned counsel appearing for the respondent no. 1 immediately. W.P.A. 10180 of 2020 is disposed of by directing the respondent no. 1 to hear out and decide the appeal pending at the behest of the petitioner, details of which have been provided in the present writ petition, as expeditiously as possible, positively within two months from this date.

There will be no order as to costs.

The parties are directed to act on the server copies of this order as and when uploaded in the official website of the Court. In any event, the petitioner is granted liberty to communicate the gist of this order to the respondent no.1 even without waiting for such server copy to be uploaded and the respondents are directed to act upon such communication.
