This is an application, praying for disposal of the application under Section 10 of the Code of Civil Procedure, filed in connection with Title Suit No. 257 of 2012, pending before the learned Civil Judge (Junior Division), 2nd Court at Baruipur, South 24 Parganas.

The petitioner submits that the application is pending for the past two years and it is further submitted that the suit has also proceeded very slowly on and from 2012.

It appears that some time was consumed in disposing of an application for substitution. Such substitution has been allowed by an order dated August 2, 2018.

Thus, I do not find any impediment in giving a direction upon the learned court below to dispose of the pending application under Section 10 of the Code of Civil Procedure as expeditiously as possible, preferably within one month from the next date fixed.

The learned court below is also requested to dispose of the Title Suit No. 257 of 2012 expeditiously, preferably within a period of one year from the date of disposal of the connected applications.

The revisional application is, thus, disposed of. There shall be no order as to costs. The petitioner is directed to serve a copy of this application along with a server copy of the order upon the opposite parties within one week.

Urgent photostat certified copy of this order, if applied for, be given to the parties as expeditiously as possible subject to compliance of all usual formalities.
