issued a notification, inter alia, granting certain service benefits to the petitioners including service tenure until sixty years of age as well as fixed terminal and medical benefits.

The other agencies mentioned in the writ petition are, inter alia, under the (WBSRDA) PMGSY Wing. It is, however, pointed out that the persons referred to and similarly situated like the petitioners under other schemes are getting higher remuneration and benefits.

petitioners claim parity of pay and benefits, inter alia, similar to those mentioned in annexures at pages 84A, 86A and 87A of the writ petition.

This Court is of the view that the matter should be dealt with by the Government first. In those circumstances, let the Joint Secretary, Finance, Government of West Bengal as may be nominated by the Chief Secretary decide the claim of the petitioners, in consultation with the Joint Secretary (Personnel), PWD, West Bengal within a period of three months from the date of communication of a copy of this order.

and/or their legal representatives shall be heard by the said Joint Secretary, Ministry of Finance and the Joint Secretary, PWD personally and a reasoned order may be passed.

Such order should be communicated to the petitioners within a period of seven days thereof.

With the aforesaid directions, the instant writ petition is disposed of.
