Mr. Prabir Mazumdar .....For the Petitioner Mr. Saswata Gopal Mukhejee Mr. Aniket Mitra .....For the State This is an application under Section 439 of the Code of Criminal Procedure filed on behalf of the petitioner who has sought to be released on bail, inter alia, on the ground that he was arrested on 15.07.2020 and for a considerable period of time he is in jail custody.

I have heard the learned advocate appearing for the petitioner and Mr. Aniket Mitra, learned advocate appearing for the State.

It is submitted on behalf of the State that the chargesheet has already been submitted under Section 8 of the

Protection of Children from Sexual Offences Act and there is nothing left for the investigation.

Having perused the case diary in particular the statement of the victim girl recorded under Section 164 of the Criminal Procedure Code, the prayer for bail, at this stage, is refused.

Accordingly, CRM 10090 of 2020 is disposed of. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of the requisite formalities.
