The petitioner prays for implementation of the order of demolition passed by the Uttarpara-Kotrung Municipality in respect of holding No. 25, Br.B.G.T. Road, Bhadrakali, District-Hooghly.

It has been submitted by the learned advocate representing the private respondent that an appeal has been preferred against the order of demolition and the same is pending consideration before the Learned Civil Judge (Junior Division), 1st Court, Serampore being Misc. Appeal No. 2 of 2020.

As it appears that the order of demolition is already under challenge before the appellate forum,

accordingly, there is no requirement of proceeding with the writ petition any further.

The parties will act strictly in accordance with the order passed by the learned appellate Court.

The writ petition stands disposed of.

The information slip showing pendency of the aforesaid Misc. Appeal be kept with the records. Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
