It is submitted on behalf of the petitioner that there is delay in trial due to nonsubmission of chemical report. Learned lawyer for the State opposes the prayer for bail and submits that steps would be taken for submission of chemical report at the earliest.

Materials on record disclose recovery of narcotic substance above commercial quantity from the petitioner. In view of the aforesaid fact and in the light of the statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner. The application for bail is, thus, rejected.

Chemical report be filed before the trial Court at the earliest.
