Heard the learned Advocates appearing for the parties. It is submitted that the petitioners are not the principal accused.

Learned Advocate appearing for the State opposes the prayer for anticipatory bail.

We have considered the materials on record including the statement of witnesses. We note that the petitioners are not the principal accused who assaulted the victim. In view of the aforesaid facts, we are inclined in granting anticipatory bail to the petitioners.

Accordingly, we direct that in the event of arrest the petitioners, viz., Motin Jhamajhara @ Abdul Matin Sk., @ Jhamajhara, Sadhak Jhamajhara @ Sahadot Sk.

@ Jhamajhara shall be released on bail upon furnishing a bond

of Rs.10,000/- each, with two sureties of like amount each, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.

This application for anticipatory bail is, thus, disposed of.
