The writ petitioner was functioning as Panchyat Secretary under the Panchayat & Rural Development Department, Government of West Bengal. The petitioner was functioning at the Gobindapur Gram Panchayat at Islampur, Uttar Dinajpur. The petitioner claims that he is 101 days short of qualifying service of ten years for pension.

Since the State has authority under the provisions of paragraph 14 of the DCRB scheme of 1985 applicable to panchayat employees, the Joint Secretary, Department of Panchayat & Rural Development, Government of West Bengal being the respondent no.2 herein, shall consider the petitioner's representation dated 24th November, 2020, that shall be submitted afresh by the petitioner to the respondent no.2 herein. Let such consideration be effected by the respondent no.2 within a period of three months from the date of communication of a copy of this order. A reasoned order shall be passed and communicated to the petitioner within ten days thereof. With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.
