rkd 18.12.2020 Cr. No.28 C.R.M. 10246 of 2020 (Through Video Conference) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Kaliganj P.S. Case No. 37 of 2020 dated 21/01/2020 under Sections 22(b)(ii)/27(c)/28 of The Drugs and Cosmetics Act. And In the matter of: - Nur Salim Sk ....petitioner.

Mr. P. Karar ...for the petitioner.

Mr. S. Chakraborty ...for the State.

Having considered the materials in the case diary and bearing in the mind the prima facie involvement of the petitioner i.e. owner of the premises in the illegal storage of intoxicating drugs, we are not inclined in granting anticipatory bail to the petitioner.

The application for anticipatory bail is, thus, rejected. We, however, are surprised that offences under NDPS Act have not been arrayed in the FIR.

Superintendent of Police, Nadia is directed to take necessary steps in that regard.

Copy of the order be sent down to the Superintendent of Police, Nadia for necessary action.
