Ms. Sukanya Bhattacharya, Mr. Md. Kutubuddin ...for the State Petitioner renews his prayer for bail. It is submitted on behalf of the petitioner that he is in custody for about two years and three months.

Learned lawyer for the State opposes the prayer for bail and submits that the trial has progressed considerably. We have considered the materials on record. There are prima facie materials connecting the petitioner with the alleged rape of the victim. In view of the gravity of the offence and as the trial is at its fag end, we are not inclined to grant bail to the petitioner at this stage. The application for bail is, thus, rejected.

However, we request the trial court to expedite the trial and conclude the same at an early date preferably within a period of three months from the next date fixed for recording of evidence without granting unnecessary adjournment to either of the parties.
