11.12.2020 Sdas rejected C.R.M. 10282 of 2020 (via video conferencing) In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Goghat Police Station Case No. 164 of 2020 dated 12.08.2020 under Sections 376AB/506 of the Indian Penal Code and Section 6 of the POCSO Act.

And In Re : Kajal Dhowrah ..... petitioner Mr. Anirban Bose Mr. S. Senapati ... for the petitioner Mr. B. Panda Mr. S. Bhakat ... for the State Learned Counsel appearing for the petitioner submits that the petitioner has been falsely implicated in the instant case. There is delay in lodging first information report. He is in custody for 120 days and investigation is complete. Learned Counsel appearing for the State opposes the prayer for bail and submits that the victim is a seven year old girl who was sexually assaulted by the petitioner. Statement of the victim prima facie implicates the petitioner in the alleged crime. Delay has also been explained in her statement.

In view of the aforesaid facts and the gravity of the offence, we are not inclined to grant bail to the petitioner at this stage.

The application for bail is, thus, rejected.
